As a landlord you should be aware that you are responsible for the safety of your tenants. Your legal duties apply to a wide range of accommodation occupied under a lease or licence, including (but not limited to):
Residential premises provided for rent by local authorities, housing associations, private sector landlords, co-operatives, hostels
Rooms, let in bed-sit accommodation, private households, bed and breakfast accommodation and hotels

As a landlord, you have a responsibility to ensure the safety of your tenants
All landlords are legally obliged under the Gas Safety Regulations 1998 to ensure gas appliances such as boilers and flues are safe.
What is a landlord gas safety certificate?
A gas safety certificate is given to you when a qualified and registered engineer has assessed any gas appliances on your property.
The engineer will fill in a CP12 Certificate which is a record of assessing your property. This will be given to you and copies supplied for tenants.
The safety check must include a check on any flues, appliances, and pipework provided to your tenants. If a tenant has supplied their own appliance, you are not responsible for the appliance, but you are still responsible for the pipework and installation of it.

Do I have to give my tenants copies of the gas safety certificate?
Yes. You should give a copy of the gas safety cert to new tenants before they move in and to existing tenants within 28 days of the engineer carrying out any checks.
How to get a gas safety certificate
Choose a Gas Safe registered heating engineer to carry out a service on your property. Check either by asking the engineer or on the Gas Safe Register that they are indeed registered, as it your responsibility to do so.
If you have a particular boiler brand, it is also advantageous to book an engineer who has experience with this type of boiler.
What is the cost of a landlord gas safety certificate?
The price depends on the engineer. The average price of a gas safety certificate ranges from £60 to £90 depending on the location of the property.

How often do you need a landlord gas safety certificate?
A service of your property should be carried out once a year.
It is not only your legal obligation to have a record of the service but servicing your boiler and flues can prevent any unexpected and costly break downs.
How to book a gas safety check?
Simply book in a time for an engineer to visit the property.
Remember you must get permission from the tenants for the engineer to enter the property and they must be given at least 24 hours’ notice.
If the engineer finds any problems, you should have repairs carried out as soon as possible.
What happens if I don’t get a gas safety check?
The cost of a gas safety check is insignificant compared to the cost of putting your tenants at risk.
Not only are you risking your tenant’s health and safety but you are breaking the law which could lead to a substantial fine or custodial sentence.
Your tenants can report any gas safety issue to the Heath and Safety Executive. They could also go to the local council and the Environmental Health Department. The tenants could also sue you and go through the courts.
The price of a safety check doesn’t seem so bad after all.
Landlords and carbon monoxide detector alarms
Carbon monoxide is an odourless gas that can leak from solid fuel sources and can be fatal.
If you are a private rented sector landlord, then you are required to have at least one smoke alarm on every floor and a carbon monoxide alarm in any room where solid fuel is used.
You can get an affordable carbon monoxide alarm from many businesses which should comply with the British Standard EN 50291 which will last several years.
It is important to take note of this date which is printed on the carbon monoxide alarm and replace it before it expires.
Do I need a landlord gas safety certificate for a new boiler?
You must have a gas safety check carried out within 12 months of a new appliance or flue installed.

It replaced CORGI on 1st April 2009. Gas Safe Register is responsible for the registration and regulation of gas engineers. Membership is mandatory for any company or engineer working with gas appliances.
